Liberal Supreme Court Justice Sides With Trump Admin In Key Case

A recent immigration case drew attention after U.S. Supreme Court Justice Elena Kagan declined to block the deportation of a Mexican family seeking to remain in the United States. The case involved Fabian Lagunas Espinoza, Maria Angelica Flores Ulloa, and their two sons, who had asked the Court to intervene so they could continue their appeal.

The family argued that returning to Mexico would place them in serious danger due to threats from the Los Rojos drug cartel. According to court filings, they fled their home in Guerrero in 2021 after cartel members allegedly ordered them to leave within 24 hours or face death. They also cited violence against relatives as part of their claim for protection.

Despite these concerns, an immigration judge denied their request for relief. That decision was later upheld by the Board of Immigration Appeals in 2023 and affirmed again by the Ninth Circuit Court of Appeals in 2025. With their legal options narrowing, the family turned to the Supreme Court in a final effort to delay deportation.

Justice Kagan chose to deny the request without referring the matter to the full Court, effectively allowing the deportation process to proceed. The decision was issued without additional explanation, which is not uncommon in emergency appeals.

The case highlights the ongoing challenges faced by migrants seeking asylum in the United States, as well as the strict legal standards applied in immigration proceedings at multiple levels of the judicial system.
